Seminar Download: Sales Contract Law and Competition Law

The so-called "blacklist" of the German Act Against Unfair Competition (UWG) is a list in the appendix of the Act containing 30 practices that are always considered unfair, regardless of further circumstances. The practices listed are prohibited per se. These include bait-and-switch tactics, advertising with self-evident claims, and much more. Violators may face a cease-and-desist letter.

In the first two blocks, lecturer Sabine Brüggemann, legal counsel of SYNAXON AG, explains the legal framework, dangers, and legal consequences of impermissible advertising.

The topic of sales contract law begins with the general terms and conditions (GTC). Since GTC are not automatically incorporated into the contract, even the best GTC are worthless without their inclusion. A reference to the GTC only after the contract has been concluded, for example on an invoice or delivery note, is too late.
